This website is operated by Whimsie Todd LLC (“Whimsie Todd,” “we,” “us,” or “our”). By visiting our website, purchasing a product, creating an account, or otherwise using our website or services (collectively, the “Services”), you agree to these Terms of Service (“Terms”).

Please read these Terms carefully before using our website. If you do not agree with these Terms, you should not use our Services.

We may update these Terms periodically by posting a revised version on this website. Your continued use of our Services following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.

1. Online Store Terms

You may not use our website or products for any illegal or unauthorized purpose.

2. Products

Whimsie Todd creates and sells children's clothing, Biblette™ interchangeable collars, accessories, and related products.

Certain products may be offered in limited quantities, seasonal collections, preorders, special releases, or limited-edition drops.

We reserve the right to:

Limit quantities available for purchase
Limit sales to particular individuals or geographic regions
Modify or discontinue products
Change product descriptions or specifications
Correct pricing or inventory errors
Cancel orders when reasonably necessary

We make reasonable efforts to accurately photograph and describe our products. However, colors may appear differently depending on your screen, lighting, device, and other factors.

Because many Whimsie Todd products incorporate fabric, embroidery, trim, or other textile elements, slight variations may naturally occur between individual pieces.

3. Biblettes™ & Intended Use

Biblette™ is an interchangeable children's collar designed to be worn with compatible clothing.

Customers are responsible for selecting an appropriate size and using products according to applicable product descriptions, care instructions, safety information, and age recommendations.

Children should be appropriately supervised while wearing or using Whimsie Todd products.

Products should be discontinued from use if they become damaged in a way that could create a safety concern.

Nothing in these Terms limits any rights available to consumers under applicable product safety laws.

4. Personalized, Monogrammed & Embroidered Products

Whimsie Todd may offer personalization, monogramming, embroidery, or products intended to be customized by Whimsie Todd or participating third-party embroiderers.

Customers are responsible for reviewing all personalization information before submitting an order.

This includes:

Names
Initials
Monogram order
Thread colors
Fonts or styles
Spelling
Other personalization selections

Once personalization or embroidery has begun, an order generally cannot be changed, canceled, returned, or exchanged, except where required by law or where the product arrives defective or differs materially from the order submitted.

Please carefully review personalization before placing your order.

Whimsie Todd is not responsible for personalization errors resulting from incorrect information submitted by the customer.

5. Third-Party Embroidery & Customization

Customers may choose to have Biblettes or other Whimsie Todd products customized by independent embroiderers, monogrammers, retailers, or other third parties.

Unless expressly stated otherwise, these businesses are independent from Whimsie Todd.

Whimsie Todd is not responsible for damage, errors, alterations, embroidery mistakes, staining, shrinking, or other changes caused after a product has been delivered to and modified by an independent third party.

Once a Whimsie Todd product has been embroidered, monogrammed, altered, or otherwise customized by a third party, it cannot be returned to Whimsie Todd, except as otherwise required by applicable law.

6. Pricing

All prices are listed in U.S. dollars unless otherwise indicated.

Prices may change without notice.

Applicable taxes, shipping charges, and other fees will be calculated and displayed during checkout when applicable.

We make reasonable efforts to provide accurate pricing. If a product is mistakenly listed at an incorrect price, we reserve the right to correct the error or cancel the affected order.

If payment has already been collected for an order we cancel due to a pricing error, we will refund the amount collected for the canceled item.

7. Orders

Submitting an order does not necessarily constitute our acceptance of that order.

We reserve the right to refuse, limit, hold, or cancel an order when reasonably necessary, including orders we believe may involve:

Fraud
Unauthorized payment activity
Abuse of promotions
Inventory manipulation
Automated purchasing
Incorrect pricing
Resale activity inconsistent with our policies
Violations of these Terms

If we cancel an order after payment has been collected, we will refund the applicable canceled amount.

8. Payment Information

You agree to provide current, complete, and accurate billing and purchase information.

Payments may be processed by third-party payment providers. Your use of those payment services may also be subject to the provider's applicable terms and privacy practices.

We reserve the right to request additional information when reasonably necessary to verify an order or payment.

9. Shipping & Delivery

Shipping options and applicable charges will be displayed during checkout.

Delivery dates and transit times are estimates unless expressly stated otherwise.

Whimsie Todd is not responsible for delays caused by shipping carriers, weather, natural disasters, incorrect addresses supplied by customers, customs, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

If a package is returned because of an incorrect or incomplete address provided by the customer, additional shipping charges may apply before the order is resent.

10. Returns & Exchanges

Returns and exchanges are governed by the Whimsie Todd Return & Exchange Policy, which is incorporated into these Terms by reference.

Items must meet the requirements stated in that policy to qualify for return or exchange.

Unless otherwise stated in our Return & Exchange Policy or required by law, the following may be final sale:

Personalized products
Monogrammed products
Embroidered products
Products altered after purchase
Products customized by a third party
Certain clearance or final-sale merchandise

Please review our current Return & Exchange Policy before purchasing.

11. Preorders & Limited Releases

Certain products may be offered for preorder or before inventory has arrived at our facilities.

Estimated shipping dates for preorder merchandise are estimates and may change due to manufacturing, transportation, customs, quality-control, or other delays.

If an order contains both preorder and in-stock merchandise, items may ship together or separately depending on the information provided at checkout or on the applicable product page.

Limited releases and seasonal merchandise may sell out and may not be restocked.

12. Promotions, Discounts & Giveaways

Whimsie Todd may periodically offer discounts, promotions, giveaways, contests, or other special offers.

Additional rules or eligibility requirements may apply.

Unless expressly stated otherwise:

Promotions cannot be combined
Promotions have no cash value
Discounts cannot be applied retroactively
Promotions may be modified or discontinued
Certain products may be excluded

If separate promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.

13. Wholesale & Resale

Whimsie Todd may separately authorize certain retailers, embroiderers, boutiques, or other businesses to purchase products for resale.

Purchasing products through our consumer website does not automatically authorize a purchaser as an official Whimsie Todd retailer, dealer, distributor, or representative.

Authorized wholesale relationships may be governed by separate wholesale terms.

You may not represent yourself as an authorized Whimsie Todd retailer, partner, representative, or affiliate without our written authorization.

14. Intellectual Property

The Whimsie Todd website and its contents—including product designs, photographs, illustrations, graphics, text, logos, product names, packaging, website design, and other original materials—are owned by or licensed to Whimsie Todd and may be protected by copyright, trademark, trade dress, and other intellectual property laws.

Whimsie Todd™, Biblette™, associated logos, product names, designs, and brand elements may not be used in a manner that falsely suggests affiliation, sponsorship, authorization, or endorsement.

Except as permitted by law or with our prior written permission, you may not reproduce, distribute, sell, commercially exploit, modify, or create derivative commercial works from our website content or brand assets.

15. Automated Scraping & Artificial Intelligence

Except where prohibited by applicable law, you may not use automated tools, bots, scrapers, crawlers, artificial intelligence systems, or similar technologies to systematically extract Whimsie Todd product photographs, original illustrations, product descriptions, pricing information, proprietary designs, or other protected website content for commercial purposes without our written permission.

You may not use Whimsie Todd's protected original content or proprietary brand assets to train or develop commercial artificial intelligence or machine-learning systems without our written authorization.

16. User Content, Reviews & Photographs

Customers may have opportunities to submit reviews, photographs, comments, contest entries, feedback, or other content.

You represent that content you submit does not violate another person's copyright, trademark, privacy, publicity, or other rights.

You may not submit unlawful, threatening, defamatory, obscene, fraudulent, malicious, or intentionally misleading content.

Whimsie Todd may remove user content from its website or social channels when reasonably appropriate.

If Whimsie Todd wishes to use identifiable customer photographs or other user-generated content in advertising or promotional materials beyond the permissions provided by the applicable platform or submission process, we may seek additional permission where appropriate or legally required.
